been arrested have pending visa any remote chance entry to usa?

I am uk citizen and have a xmas day flight to new york with my family for 5 night holiday.
this was booked in march but unfortunately I was arrested in July for a minor offence relating to trading standards.
I have tried to do all the right things attended an appointment at embassy only to be told that as case is still ongoing they can not process a visa and it is now pending.
I wish it had said that on website as it was a pointless and expensive exersise as I had to fly from uk to befast as no london appointments available.
as this is a special family xmas trip I am clinging to any slight chance that if I travel I can have an interview when I get there and may be allowed in.
anyone had any experience of this or it is 100 percent certain I will be sent home ?
even a remote chance is better than just giving up and being home alone.
help please !!!!!
